Statement to XM Subscribers - The XM Nation
Everything we’ve done at XM since our first minute on the air is about giving you more choices. We provide more channels and music programming than any other network. We play all the music you want to hear including the artists you want to hear but can’t find on traditional FM radio. And we offer the best radios with the features you want for your cars, homes, and all places in between.
We’ve developed new radios — the Inno, Helix and NeXus — that take innovation to the next level in a totally legal way. Like TiVo, these devices give you the ability to enjoy the sports, talk and music programming whenever you want. And because they are portable, you can enjoy XM wherever you want.
The music industry wants to stop your ability to choose when and where you can listen. Their lawyers have filed a meritless lawsuit to try and stop you from enjoying these radios.
They don’t get it. These devices are clearly legal. Consumers have enjoyed the right to tape off the air for their personal use for decades, from reel-to-reel and the cassette to the VCR and TiVo.
Our new radios complement download services, they don’t replace them. If you want a copy of a song to transfer to other players or burn onto CDs, we make it easy for you to buy them through XM + Napster.
Satellite radio subscribers like you are law-abiding music consumers; a portion of your subscriber fee pays royalties directly to artists. Instead of going after pirates who don’t pay a cent, the record labels are attacking the radios used for the enjoyment of music by consumers like you. It’s misguided and wrong.
We will vigorously defend these radios and your right to enjoy them in court and before Congress, and we expect to win.

It’s great to see XM Radio standing their ground and not allowing the RIAA to bully them around. Sirius should thank XM for fighting this battle for Satellite Radio.
Update: Sirius also has had their share of problems with record labels, as tussel points out.

Sirius doesn’t have a live, portable satellite receiver that’s capable of recording while you listen. This fight is XM’s alone — Sirius doesn’t have the technology yet.

I’m a Sirius subscriber but I agree 100% with XM on this. They should organize with Sirius and fight the legal battle to end this crap once and for all. People don’t spend hundreds of dollars on satellite radios to pirate music, they do it to support music.
The RIAA is biting the hand that feeds now. Even the artists are starting to wake up to this. Hopefully it won’t be long now before we stop hearing of these ridiculous charges brought up by the RIAA.

They’d better win. If any court even gives the RIAA the time of day, it would undoubtedly be the product of either gross ignorance or bribery. I remember reading about the royalties settlement and thinking it almost sounded fair, but this is ridiculous.

XM sucks… sirius is better. I had to say that in response to that bullshit claim that “We play all the music you want to hear including the artists you want to hear but can’t find on traditional FM radio.” I had XM for a year. Hated it, simply. I never found a decent station for my style of music. I would honestly say that there were 10 occasions while boating that I heard one of the artists in my personal collection, and then the next 10-20 songs were NOTHING like the song, different genres altogether. Mixing it up is fine but a person should be able to go to one station. I hope XM dies.
That being said :). The RIAA sucks more and their lawyers should be shot on sight. They are the poster child for money hungry lawsuit happy companies who manage to even sue people for downloading music who have never owned a computer. I’m sure many of you read that article. As much as I hate XM I am glad they are fighting back. I hope they win but go broke :). Forgive me for my personal opinions, but I am still in awe of how much my type of music was IGNORED on XM whereas on Sirius there are several stations with my music. Death to the xxAA’s

This is in response to King Dave Wallace. if you cant find one station on XM “that suits your music style.” branch out and learn to accept other types of music. and sirius is the exact same type of music that xm is. so please just stfu about the xm channels and focus on the main point of the article

This is a fee based service. Just because the service earns fees the riaa should not double dip. if the artists are paid royalties for these fees they must have some clue that people may record them if not with these radios in other forms.

Xm is the better of the 2 companies. Sirius has some good stuff too but the customers that buy xm tend to be educated professionals and the customers for sirius tend to be low brow knuckle draggers. I sell both systems everyday and that’s the truth. Xm subscribers probably agree with this, and sirius customers… well they probably can’t use a computer so who cares what they think.
